Specialized Legal Consultation

If you are already married in community of property, changing your matrimonial property regime requires a High Court application. Our attorneys can assess your circumstances and advise whether a Section 21 application may be appropriate for you.

Why You Must Speak to an Attorney

Once a marriage has been concluded in community of property, changing your matrimonial property regime can no longer be achieved by signing an antenuptial contract. Instead, the law requires a formal application to the High Court in terms of Section 21 of the Matrimonial Property Act.

⚖️ Court Approval Required

Every Section 21 application is considered on its own facts. The Court must be satisfied that there are sound reasons for the proposed change and that no person, including creditors, will be unfairly prejudiced. The process generally involves legal consultations, affidavits, statutory notices, and a formal High Court application. Because of its complexity, this service is provided directly by our attorneys and is not available through the B4 I Do Client Portal.

If you would like to determine whether a Section 21 application is suitable for your circumstances, please contact our attorneys to arrange an in-person or virtual consultation.
